Terms and Conditions for LystGenie

1. Introduction

Welcome to LystGenie. These Terms and Conditions ("Terms") govern your use of the LystGenie mobile application ("App") and services. By creating an account, downloading, or accessing LystGenie, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Account Registration

To use LystGenie, you must create a profile using your phone number. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password/OTP for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. User-Generated Content (UGC)

LystGenie allows users to create wishlists, upload images, write descriptions, and interact within "GroupLysts." You retain ownership of the content you post, but you grant LystGenie a non-exclusive, worldwide license to use, display, and distribute this content within the App for the purpose of providing our services.

4. Acceptable Use and Conduct Policy

We are committed to maintaining a safe, family-friendly environment. We have a Zero Tolerance Policy for objectionable content. By using LystGenie, you strictly agree NOT to post, upload, share, or link to content that includes:

  • Pornography and Nudity: Any depiction of sexual acts, nudity, or sexually suggestive material is strictly prohibited.
  • Profanity and Offensive Language: The use of vulgar, obscene, or profane language in product descriptions, group chats, or user profiles is prohibited.
  • Obscene or Malicious Links: You may not post links that direct users to pornography, gambling, malware, phishing sites, or any other content deemed obscene or harmful by LystGenie.
  • Harassment and Hate Speech: Bullying, harassment, or discrimination based on race, ethnicity, religion, gender, or sexual orientation is not tolerated.

Enforcement: LystGenie reserves the right to monitor User Content. If you violate this policy, we reserve the right to:

  1. Remove the offending content immediately without notice.
  2. Suspend or Permanently Terminate your account, depending on the severity and frequency of the violation.
  3. Report illegal content to law enforcement authorities.

5. SoloLysts, GroupLysts, TrackLysts and Privacy

LystGenie is designed for sharing information within groups. By joining a SoloLyst or GroupLyst, you acknowledge that other members of that group will be able to view your wishlist items. You agree not to use information obtained from the App to harass or harm other users.

6. Third-Party Retailers

LystGenie provides search functionality that connects to third-party retailers (e.g., Amazon, Target, etc.).

  • LystGenie does not sell, ship, or fulfill these products.
  • We are not responsible for the accuracy of pricing, availability, shipping times, or return policies of third-party retailers.
  • Any transaction you make is strictly between you and the retailer.

7. Intellectual Property

The LystGenie App, including its code, design, logos, and “Sololyst,” "GroupLyst," and “TrackLyst” terminology, is the intellectual property of LYSTGENIE and is protected by copyright.

8. Disclaimer of Warranties

LystGenie is provided "as is" and "as available." We do not guarantee that the App will be error-free, secure, or uninterrupted. We are not responsible for duplicate purchases, missed gifts, or family disputes arising from the use of the App.

9. Termination

We may terminate or suspend your access to LystGenie immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will cease immediately.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of United States of America, without regard to its conflict of law provisions.

Key Considerations for Apple Submission:

Since your app allows users to post content that others see (User Generated Content), Apple requires you to have specific mechanisms in place. Based on the Terms above, you must ensure your app technically supports:

  1. Reporting: A button for users to report offensive wishlists or profiles.
  2. Blocking: The ability for a user to block another user.
  3. Moderation: You (the admin) must have the ability to delete posts and ban users effectively.
